This Digital Millennium Copyright Act (DMCA) Policy (“Policy”) governs the procedures and requirements for making claims of copyright infringement related to content posted on the website www.journalpress.com (“Website”). This Policy outlines the steps to submit a proper DMCA notice and the actions taken by Journal Press (“Journal Press,” “we,” “us,” or “our”) in response to such notices.
Copyright Infringement Claims
(a) Notification: If you believe that any content on the Website infringes your copyright, you must submit a written notification (“DMCA Notice”) to our designated contact email address at contact@journalpress.com. Your DMCA Notice must include the following information:
i. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
ii. Identification of the copyrighted work(s) claimed to have been infringed;
iii. Sufficient information to identify the allegedly infringing material, including its location on the Website;
iv. Your contact information, including your name, address, telephone number, and email address;

vi. A statement, made under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
(b) Counter-Notification: If you believe that your content was wrongly removed from the Website in response to a DMCA Notice, you may submit a written counter-notification (“Counter-Notice”) to our designated contact email address at contact@journalpress.com. Your Counter-Notice must include the following information:
i. Your physical or electronic signature;
ii. Identification of the material that has been removed or disabled and its location prior to removal;
iii. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
iv. Your contact information, including your name, address, telephone number, and email address;
v. A statement that you consent to the jurisdiction of the federal district court in which your address is located or, if outside the United States, that you consent to the jurisdiction of the federal courts located in the district where the Website is hosted;
vi. A statement that you will accept service of process from the party who submitted the original DMCA Notice or an agent of such party.
Actions Taken
Upon receipt of a valid DMCA Notice or Counter-Notice, we will take the following actions:
(a) DMCA Notice: If we receive a valid DMCA Notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material of the removal or disablement.
(b) Counter-Notice: If we receive a valid Counter-Notice, we will promptly review the Counter-Notice and may, at our discretion, restore the removed material within ten (10) business days, unless the original claimant notifies us of legal action seeking a court order to restrain the allegedly infringing activity.
Repeat Infringers
We respect intellectual property rights and will take appropriate action against users who repeatedly infringe copyrights. In our sole discretion, we may terminate the accounts of users who are determined to be repeat infringers.
